Interviewer: Well, how often do these charges stick, burglary and trespassing? If the person doesn't have burglary tools?

Acacia Law: They stick pretty easy. What I found is that a lot of lawyers, I think, has been my experience, sort of lay down on those because the statute seems so cut and dry. My perspective and the way I always approach these things is by analyzing what was the intent of the client at the time they were inside the structure? And that is where you can make a lot of headway, but it is something that a lot of people don't realize is going to amount to more trouble that has to be addressed with the prosecutor. And it gives the state more leverage because the more charges they come up with against you, the more defenses that you have to come up with and the more fighting you have to do in court in order to get a client the best result.
